Democratic Gov. Matt Meyer has signed an executive order that establishes Delaware as a legal shield state for individuals seeking or providing gender-alteration procedures, including for minors.
Executive Order 11, signed on June 20 at CAMP Rehoboth alongside lawmakers, advocates and members of the Delaware LGBTQ+ Commission, explicitly protects the confidentiality of both patients and healthcare providers, barring state agencies from assisting out-of-state investigations or legal actions that target individuals for receiving or delivering care that is legal in Delaware.
It also prohibits professional licensing boards of Delaware from disciplining providers solely for administering “gender-affirming” treatments.
“Across the country, people are being punished for seeking or providing gender-affirming care,” Meyer said in a press release. “In Delaware, we cherish privacy, dignity and the right to make personal medical decisions. Everyone deserves the freedom to access healthcare rooted in science and compassion.”
This move comes even after President Donald Trump signed an executive order banning federal funds to health entities that transition minors earlier this year.
The executive order, which targets “chemical and surgical mutilation” of children, declares it is now the official policy of the federal government to prohibit any financial or institutional support for medical interventions that seek to alter a child’s biological sex, including puberty blockers, hormone therapies and surgeries often referred to as “gender-affirming care.”
According to the administration, the directive aims to protect vulnerable youth from what it describes as medically unproven and potentially harmful procedures. It mandates that all federal agencies, including the Department of Health and Human Services (HHS), review and amend any guidance or policies that rely on the standards of the World Professional Association for Transgender Health (WPATH), which the order criticizes for lacking scientific integrity.
The executive order includes a definition of “chemical and surgical mutilation” encompassing puberty-blocking drugs, cross-sex hormones and surgeries intended to align a person’s body with a gender identity different from their biological sex. It further directs the government to “rigorously enforce” all existing laws that limit or prohibit such interventions. “Countless children soon regret that they have been mutilated and begin to grasp the horrifying tragedy that they will never be able to conceive children of their own or nurture their children through breastfeeding,” the order noted. “Moreover, these vulnerable youths’ medical bills may rise throughout their lifetimes, as they are often trapped with lifelong medical complications, a losing war with their own bodies, and, tragically, sterilization.”
Several studies have found that these puberty blockers, cross-sex hormones and irreversible surgeries can result in sterilization and carry potential long-term health risks, including cardiovascular complications, reduced bone density and psychological effects. But Democrats and LGBTQ+ advocates still describe transgender interventions as “lifesaving,” supporting laws that could harm minors throughout their lifetime.
